The law in Texas, in plain English
Betting on a game is a misdemeanor under Chapter 47 of the Texas Penal Code, and the state constitution means a new form of gambling needs a two-thirds vote in both chambers and then approval at the ballot box. The Legislature sits in regular session only in odd-numbered years. The 2025 session ended without sending voters a sports betting amendment, and the next one opens Jan. 12, 2027. In March 2026, Lt. Gov. Dan Patrick told the Senate State Affairs Committee to study prediction markets ahead of that session; the committee has since heard testimony, but Texas has not sued or ordered out any exchange.
For Cowboys fans in Texas, the legal route is a federally regulated exchange. Novig, regulated by the CFTC, lets you take a position on a game at a price set by other traders rather than by a house, and it is live in Texas, as are Kalshi and Polymarket US. You must be 21 to use Novig.
